“The Americans are not interested in this”

The Minister of foreign Affairs of Poland Jacek Czaputowicz proposed to appoint envoy of the UN Secretary General on Ukraine.

“I propose to appoint a special envoy of the UN Secretary General for Ukraine. I think the so-called Normandy format (Germany, France, Ukraine, Russia) should join the US and the EU. Germany and France may think they represent Europe, but, in our opinion, this is not the case,” he said.

The political scientist Ruslan Bortnik believes that in this way the Polish Minister voiced the initiative to resume the Geneva format of negotiations on Donbas. But Poland have never participated, and this desire is due to political motives.

“Poland actively criticizes the policy of Germany and France. She is using the Ukrainian situation to criticize these countries and demonstrate the failure of the German – French policy,” – said the analyst.

He noted that after the beginning of withdrawal from the EU, the UK, Poland, supported by the United States, began to increase the effect. They say that the Polish government is trying to use this point, making loud statements on foreign policy.

For example, at the end of December Jacek Czaputowicz said that France is now “out of order” and called France “the sick man of Europe”. The statement was associated with the mass protests in the country. And address in Germany from the lips of the Polish Minister accusations of “anti-European” position.

The Polish side criticized Germany for the construction of a joint with Russia gas pipeline “Nord stream – 2”. Note, however, that it would serve as a competitor to Poland, which signed a contract for the supply of liquefied gas from the US, including for sale.

Germany and France are the object of Polish critics for a long time. In December 2017 the former Minister of foreign Affairs of Poland Witold Waszczykowski said: “Germany and France are lured Kiev assurances that the Minsk format will bring results. It is difficult thus to reach peace agreements. Chance to it would be in the Geneva format.”

Recall that in April 2014, in Geneva talks were held with the participation of representatives of Ukraine, Russia, the US and the EU to resolve the crisis in the Donbas. The format of the negotiations became known as “Geneva”. However, later in Minsk for talks were joined by Germany, France and the leaders of the so-called “LDNR”, and the US is no longer involved. Although Warsaw in 2015 proposed to postpone the negotiations in the “Geneva format”, with the participation of the United States and Poland, the initiative has not found support.

Waszczykowski year ago, admitted: “We propose a return to the broader format, such as Geneva, which would include also the United States. But the Americans are not interested in this”.

Now Jacek Czaputowicz took the initiative to introduce the post of special envoy of the UN Secretary General for Ukraine. Such messengers are available for Iraq, Yemen, Lebanon, Syria, etc.

“The future status”

The special envoys of the UN Secretary General to act in certain organizations. For example, the envoy for the Cyprus appointed in the Armed forces of the UN peacekeeping in Cyprus. Special envoy of the Secretary General Kosovo with the UN Mission for the interim administration in Kosovo.

It should be assumed that the corresponding messenger will appear after hypothetical introduction in the Donbass UN peacekeepers. The terms of reference of the special envoy of the Secretary-General defined the mandate of the United Nations in accordance with the relevant Security Council resolution. In the UN security Council include Russia, which has veto power. Without her consent nor the introduction of peacekeepers, nor the purpose of the messenger is impossible.

Note that the powers of the envoy of the UN Secretary-General included: a comprehensive review of the provisions and facilitating the political process aimed at determining the future status of the region. The special envoy reports directly to the Secretary General. And based on the reports of the envoy of the Secretary-General takes a political decision on whether there were conditions conducive to the beginning of the process to determine the future status of the territory.

However, in Ukraine accepted the law on reintegration of Donbass, which sets policy for ensuring the state sovereignty of Ukraine in the Donetsk and Lugansk regions. No other future status, in addition to the reintegration of the territories, Ukrainian legislation does not provide.

Ruslan Bortnik said: “to Expect that the appointment of Ambassador to the United Nations in Ukraine will lead to the resolution of the conflict in the Donbas is unlikely”.

The political scientist believes that the Polish initiative will not be implemented. They say it is just information and the political struggle between Poland and other EU countries.

“All is fair understand that the root of the problem is the us-Russian confrontation. The agreement between them is unlikely to reach profound progress in the Ukrainian situation,” he said.

In his opinion, participation in negotiations, the special Ambassador of the UN, or the new representatives of the European Union instead of Germany and France, can only revive in some measure the political dialogue of the Minsk agreements.

He recalled that the Minsk agreement was legalized at the international level, the resolution of the UN Security Council on 17 February 2015. At the talks in Minsk, the Ukrainian side has committed itself to pardon participants in an armed confrontation in the Donbass, to hold elections and to introduce a special procedure for local government. Also the Minsk agreements provide for constitutional reform in terms of decentralization, after which Ukraine must return control of the border.

The power of constitutional reform does not hold, and States that the control over the Russian-Ukrainian border, allegedly, will help to return the peacekeepers. However, the UN security Council will hear a resolution on the introduction of the UN peacekeeping mission in the Donbass without the occurrence of the progress in the work and “Minsk” formats, said the permanent representative of Ukraine to the United Nations Volodymyr Yelchenko.

“At present, peacekeeping operations have the decision of the UN security Council. But in order to begin to address this question, it first needs to be at least roughly indicated in the “Normandy” or “Minsk” format”, -he explained.
